The European Court of Human Rights in the case of Tom Toolan (TT) - V - Poland regarding the criminal abduction of Rhian Toolan has ruled: 

​

  • Poland Violated Article 8 (Right to respect for family life)

  • Poland failed to take adequate and effective steps to enforce the child’s   return order.

​

  • While initial steps were timely, subsequent enforcement actions were marred by delays, ineffective procedures, and a lack of coordination.

​

  • Authorities repeatedly relied on flawed or misleading information, took ineffective actions, and failed to adjust their strategy when previous steps failed.

​

  • Despite clear judicial orders and repeated sightings of the child and mother, enforcement was not meaningfully pursued.

​

  • The failures were primarily attributable to the authorities, not solely the mother’s actions.
